accessing or using Zero Charts (zerocharts.com.br), you confirm that you have
read, understood, and agreed to these Terms of Service ('Terms'). If you do not
agree with any part of these Terms, please do not use the platform.
Zero
Charts is available globally and these Terms apply to all users regardless of
their country of residence. Mandatory local consumer protection laws that
cannot be waived by contract continue to apply.
Zero Charts is a platform for music lovers who want to track and visualize their listening habits. Through integration with Last.fm, the service provides:
•
Weekly charts listing your most-listened artists,
songs, and albums;
•
Historical view of your musical evolution over time;
•
Statistics, curiosities, and a real-time Live Chart;
•
Certificates and plaques for milestone tracks and
albums;
•
Access to premium features through a subscription
plan.
All subscriptions and payments on Zero Charts are processed by Paddle.com Market Limited ('Paddle'), acting as the Merchant of Record. This means:
•
Your purchase contract is with Paddle, not directly
with Zero Charts;
•
Paddle is responsible for billing, receipts, refunds,
and local tax compliance (including VAT/GST as applicable in your
jurisdiction);
•
Payment data (credit card details, etc.) is collected
and stored exclusively by Paddle — Zero Charts does not store your payment
information;
•
Paddle's own Terms of Service and Privacy Policy apply
to payment processing.
Subscriptions
renew automatically at the start of each billing period. You may cancel at any
time before your renewal date via the Paddle subscriber portal. Cancellations
do not generate a pro-rata refund for the current period, except where required
by applicable law.
Refund
requests are handled by Paddle. EU and UK users have a 14-day right of
withdrawal for digital purchases, unless access to the digital content begins
before that period with your express consent. Additional refund rights may
apply under your local consumer protection law.
You
must have an active Last.fm account to use Zero Charts. Registration requires
authorizing Zero Charts to access your Last.fm account and providing an email
address and password specific to Zero Charts.

Provide accurate and up-to-date information;
•
Keep your password confidential and do not share it;
•
Notify us immediately if you suspect unauthorized
access to your account;
•
Be responsible for all activity that occurs under your
account.
You
agree not to use the platform to:
•
Engage in any illegal or unauthorized activity;
•
Gain unauthorized access to systems, servers, or
networks;
•
Interfere with or disrupt the platform's operation;
•
Reverse engineer or attempt to extract the source
code;
•
Use bots or automated scripts to access the service in
unintended ways;
•
Create multiple accounts to circumvent restrictions or
limitations.
Zero
Charts relies on the Last.fm API to function. By using our platform, you
acknowledge that:
•
Last.fm's collection and use of your data is governed
by Last.fm's own Privacy Policy and Terms;
•
Zero Charts is not responsible for Last.fm API
failures, unavailability, or changes;
•
Revoking Zero Charts' access to your Last.fm account
will prevent chart generation or updates.
All
content on the platform — including source code, design, logos, text, and
features — belongs to Zero Charts or its licensors. You are granted a limited,
non-exclusive, non-transferable, revocable license to access and use the
platform for personal, non-commercial purposes only.
The
service is provided 'as is' and 'as available' without warranties of any kind.
Zero Charts is not liable for service interruptions, data inaccuracies from
Last.fm, or any direct or indirect damages arising from use or inability to use
the platform.
Nothing
in these Terms excludes liability that cannot be excluded by law, including
statutory consumer guarantees available under applicable local legislation.
These
Terms are governed by the laws of Brazil. Users in other countries may also
benefit from mandatory protections under their local law that cannot be waived
by contract.
For
EU users: consumer disputes may be submitted to the EU Online Dispute
Resolution platform at ec.europa.eu/odr. For UK users: you may contact the
relevant UK authority or use alternative dispute resolution services. For
Brazilian users: the Consumer Protection Code (Law 8,078/1990), the Internet
Civil Framework (Law 12,965/2014), and the LGPD (Law 13,709/2018) apply.
We
will always attempt to resolve disputes amicably before pursuing formal legal
action.
We
may update these Terms at any time. Changes take effect upon publication on the
platform. For material changes, we will provide reasonable advance notice.
Continued use of the platform after changes constitutes acceptance of the
updated Terms.
